Ces études, plus nombreuses dans le monde nord-américain, participent plus généralement des recherches sur la question des femmes et du genre dont le développement a été favorisé par le contexte des mouvements féministes des années 1970. Parmi les thèmes développés, il y a la question de la féminité des religieuses, leur rapport au travail, leur organisation interne et leur action sociale. Si les interrogations se recoupent au (...) Canada, aux États-Unis et en France, les conclusions, souvent liées à des positions épistémologiques différentes, varient. I argue for a deflationary answer to the question, “What is it to be a woman?” Prior attempts by feminist theorists to provide a metaphysical account of what all and only women have in common have all failed for the same reason: there is nothing women have in common beyond being women. Although the social kinds man and woman are primitive, their existence can be explained. I say that human sex difference is the material ground of systems of gender; gender (...) systems serve to enable male control of female reproductive capacities. This explains the fact that most women are female, but it does not entail that all women are female or that all females are women. To clarify my position, I draw an analogy between the kind woman and the kind parent. While it is difficult to come up with necessary and sufficient conditions for being a parent, it is clear that the social institution or practice of parenting has its material ground in the biological facts about human reproduction together with facts about infantile dependency. Saying this does not entail that all and only biological progenitors are parents. (shrink)

Illusions are thought to make trouble for the intuition that perceptual experience is "open" to the world. Some have suggested, in response to the this trouble, that illusions differ from veridical experience in the degree to which their character is determined by their engagement with the world. An understanding of the psychology of perception reveals that this is not the case: veridical and falsidical perceptions engage the world in the same way and to the same extent. While some contemporary vision (...) scientists propose to draw the distinction between veridical experience and illusion in terms of the satisfaction or non-satisfaction of “hidden assumptions” deployed in the course of normal perceptual inference, I argue for a different approach. I contend that there are, in a sense, no illusions – illusions are as “open” as veridical experiences. Percepts lack the kinds of intentional content that would be needed for perceptual misrepresntation. My view gives a satisfying solution to a philosophical problem for disjunctivism about the good case/bad case distinction: with respect to illusions, every "bad case" of seeing an X can be equally well construed as a "good case" of seeing some Y (different from X). -/- . The tradition of Western philosophy—in particular, the ideals of reason and objectivity—has come down to us from white males, nearly all of whom are demonstrably sexist, even misogynist. What are the implications of this fact for contemporary feminists working within this tradition? This article discusses two arguments in favor of perdurance. The first is Sider’s argument from vagueness, “one of the most powerful” in favor of perdurantism. I make the observation that endurantists have principled grounds to claim that the argument is unsound, at least if endurance is formulated in locative rather than mereological terms. Having made this observation, I use it to emphasize a somewhat neglected difference between endurantists and perdurantists with respect to their views on material objects. These views, in (...) the case of endurantists, lead to a further, less than conclusive but nevertheless interesting argument against endurantism—the anti-fundamentality argument—which I discuss and tentatively endorse. That argument posits that endurantists must take location to be a fundamental relation, and that this has as a consequence the metaphysical possibility of some rather unwelcome scenarios. Perdurantists may avoid this consequence by denying that location is fundamental, perhaps by embracing supersubstantivalism. (shrink)

I want to discuss philosophically, to glance at the logic of, the parts of this expression “the justification of punishment” and then to draw from this discussion one or two morals for discussions of the justification of punishment. This paper is based on one originally given to the Scots Philosophy Club at its Aberdeen meeting in 1953, as the third part of a symposium on The Justification of Punishment.

An argument is offered for this conditional: If our current concept conscious state is sharp rather than vague, and also correct , then common versions of familiar metaphysical theories of consciousness are false--?namely versions of the identity theory, functionalism, and dualism that appeal to complex physical or functional properties in identification, realization, or correlation. Reasons are also given for taking seriously the claim that our current concept conscious state is sharp. Intuitively it has seemed to many that our concepts conscious state and conscious creature are sharp rather than vague, that they can have no borderline cases. On the other hand, many who take conscious states to be identical to, or realized by, complex physical states are committed to the vagueness of those concepts. In the paper I argue that conscious state and conscious creature are sharp by presenting four necessary conditions for conceiving borderline cases in general, and showing that some (...) of those conditions cannot be met with conscious state. I conclude that conscious state is sharp, and the conclusion is then extended to conscious creature. The paper ends with a brief discussion of some implications. (shrink)

Locke's contribution to the discussion was fourfold: First , he saw the importance of the problem; Second , he realized that the puzzle cases, the “strange suppositions,” were relevant; Third , he maintained “same” had a different meaning when applied to “person” from its meaning in other contexts; and, Fourth , he offered his much criticized solution of the problem.

It is widely assumed that ‘ consciousness ’ is multiply ambiguous within the consciousness literature. Some alleged senses of the term are access consciousness, phenomenal consciousness, state consciousness, creature consciousness, introspective consciousness, self consciousness, to name a few. In the paper I argue for two points. First, there are few if any good reasons for thinking that such alleged senses are genuine: ‘ consciousness ’ is best viewed as univocal within the literature. The second point is that researchers would do (...) best to avoid the semantics of ‘ consciousness ’, since resorting to “semantic ascent” typically serves no clear purpose in the case of consciousness, and confuses matters more than anything else. In this long-awaited book, Antony Duff offers a new perspective on the structures of criminal law and criminal liability. His starting point is a distinction between responsibility (understood as answerability) and liability, and a conception of responsibility as relational and practice-based. This focus on responsibility, as a matter of being answerable to those who have the standing to call one to account, throws new light on a range of questions in criminal law theory: on the question of criminalisation, which (...) can now be cast as the question of what we should have to answer for, and to whom, under the threat of criminal conviction and punishment; on questions about the criminal trial, as a process through which defendants are called to answer, and about the conditions (bars to trial) given which a trial would be illegitimate; on questions about the structure of offences, the distinction between offences and defences, and the phenomena of strict liability and strict responsibility; and on questions about the structures of criminal defences. The net result is not a theory of criminal law; but it is an account of the structure of criminal law as an institution through which a liberal polity defines a realm of public wrongdoing, and calls those who perpetrate (or are accused of perpetrating) such wrongs to account. As attention, in philosophy, is mainly discussed in the philosophy of mind, its ethical aspects have remained relatively unexplored. One notable exception is Iris Murdoch. Another philosopher, Maurice Merleau-Ponty, considers attention to be central for his phenomenology of perception, with important ethical implications. This paper explores the role of attention in ethics by drawing on both Murdoch and Merleau-Ponty and uses the resources they variously offer to address two questions relating to the enigmatic role of the self in attention: how (...) should we understand agency in the attending subject? And: to what extent is the subject responsible for the quality of her attention? Addressing these difficulties about the self is the key to articulating its ethical value, as well as the main apparent difference between the ethical concept and the one in ordinary language and philosophy of mind. Recently, many philosophers have been interested in using locative relations to clarify and pursue debates in the metaphysics of material objects. Most begin with the relation of exact location. But what if we begin instead with the relation known as weak location – the relation an object x bears to any region not completely bereft of x? I explore some of the consequences of pursuing this route for issues including coincidence, extended simples, and endurance, with an eye to evaluating the (...) prospects for taking weak location as our fundamental locative relation. The paper contains an argument against functionalist theories of consciousness. The argument exploits an intuition to the effect that parts of an individual's brain that are not in use at a time t, can have no bearing on whether that individual is conscious at t. After presenting the argument, I defend it against two possible objections, and then distinguish it from two arguments to which it appears, on the surface to be similar.

ABSTRACT There is currently a great deal of enthusiasm for projects known sometimes as “amelioration” and sometimes as “conceptual engineering.” Such projects advocate either the revision of existing concepts, or the intentional creation of new concepts. It is held by advocates of amelioration that projects of this sort are necessary for the accomplishment of a variety of social justice goals. So, for example, many feminist theorists hold that the concept WOMAN must be revised if we are to properly characterize and (...) struggle against women’s oppression. With regard to these projects, I will argue for three theses: 1) Amelioration/Conceptual Engineering is impossible, because there is no conception of concepts which satisfies all the prerequisites for either change or intentional replacement; 2) Amelioration/Conceptual Engineering is undesirable, because if it were possible it would amount to pernicious thought-control; and 3) Amelioration/Conceptual Engineering is unnecessary, because our political goals can be conceived using existing concepts – having a concept of WOMAN does not commit us to any particular beliefs about women. Causation appears to present us with an interpretative difficulty. While arguably a redundant relation given fundamental physics, it is nevertheless apparently pragmatically indispensable. This chapter revisits certain arguments made previously by the author for these claims with the benefit of hindsight, starting with the role of causal models in the human sciences, and attempting to explain why it is not possible to straightforwardly ground such models in fundamental physics. This suggests that further constraints, going beyond physics, are needed to legitimate (...) such models. These supplementary constraints could be reified, but that would seem to conflict with the completeness of physics. A response is to emphasize the practical role of causal talk, and the author suggests that a fictionalist approach might be worth exploring. After clarifying fictionalism as a general approach, they carry out in some detail the project of clarifying what a fictionalist attitude to causation would involve. (shrink)

In a series of influential articles, Rae Langton has argued that Austinian speech-act theory can illuminate the way in which pornography contributes to the subordination of women. I will argue that Langton’s application of Austin is incorrect. In earlier work, I have argued against Langton’s view on the grounds that being subordinated is not the sort of condition that can be brought about through an illocutionary act. In this paper, however, I will set aside that objection and focus instead on (...) Langton’s claims about the type of illocutionary act pornography might be. I will argue, first, that Langton cannot say what she wants to say about the content of pornography and still have it that pornography is a verdictive or exercitive speech act, in Austin’s sense. Verdictive and exercitive speech acts do not, and cannot describe the states of affairs they bring about. Second, I will argue that pornography does not in any case satisfy the conditions necessary for a speech act to be verdictive or exercitive. Specifically, there do not exist accepted background conventions that would give the pornographer authority to render verdicts or to take executive action. This objection to Langton’s view has been made before; I’ll show that her response to the objection betrays a confusion of authority with power. (shrink)

The use of expressions like ‘concepts of consciousness’, ‘kinds of consciousness’, and ‘meanings of ‘consciousness’’ interchangeably is ubiquitous within the consciousness literature. It is argued that this practice can be made sense of in only two ways. The first involves interpreting ‘concepts of consciousness’ and ‘kinds of consciousness’ metalinguistically to mean concepts expressed by ‘consciousness’ and kinds expressed by ‘consciousness’; and the second involves certain literal, though semantically deviant, interpretations of those expressions. The trouble is that researchers typically use the (...) above expressions interchangeably without satisfying either way of doing so coherently. The result is much error and confusion, which is demonstrated in the works of philosophers currently writing on consciousness. (shrink)

While a standard procedure in mental health internment facilities, physical restraint, as an extreme form of coercion in mental health, has been claimed to be abolished. Three sorts of arguments have been provided: an argument from dignity, and argument from informed consent, and a consequentialism argument. In this chapter we discuss these arguments and conclude that these arguments are not decisive to completely ban such forms of coercion. Restraint, in particular, may be justified in exceptional circumstances, where an imminent risk (...) for the personal integrity of anybody involved, including the person with the mental health problem. However, this sort of case is infrequent, while restraint is often the first option. This conclusion also suggests that much can be done to prevent reaching such extreme circumstances where coercion may be the only option. The discussion also clarifies how coercion should be carried out, when justified, making it supervised and as short as possible. (shrink)
